HOBIE CLASS DIVISION 12 BYLAWS
ARTICLE ONE - NAME AND GEOGRAPHIC BOUNDARIES
The name of the organization is the Hobie Class Association Division
12, hereafter referred to as the Division. The geographic boundaries
of this Division include that part of New York State east of the Hudson
River including Long Island and New York City; New Hampshire; Maine; Massachusetts;
Connecticut; Vermont; and Rhode Island.
ARTICLE TWO - PURPOSE
The Division was organized for the following purposes:

a) To encourage and promote the racing of Hobie Cat yachts and to unify
the rules in connection therewith;
-
b) To encourage and promote catamaran sailing activities among the members
of the Division and other Hobie cat organizations throughout the world;
-
c) To formulate rules governing sailing competitions among the members
and fleets of the Division;
-
d) To exercise advisory jurisdiction over activities carried on by the
members and fleets of the Division and to enforce the by-laws and rules
of the Division upon all members, fleets and individuals who are subject
to its jurisdiction;

e) To foster educational programs for the training of members in the science
of seamanship and navigation;
-
f) To provide training for candidates and crews for international, national
and regional competitions, by organizing and holding competitive events
similar in nature;
-
g.) To foster and promote public interest in the participation in
international, national, regional and divisional events;
h) No person shall be denied the right to participate in any event
within the jurisdiction of the Division or to manage or otherwise be involved
in the participation of such event, or have so participated shall suffer
any penalty for having participated, on the grounds of race, color, religion,
age, sex, or national origin. This section shall not prevent the conduct
of separate events for males and females.
ARTICLE THREE - MEMBERSHIP
Membership in this Division shall consist of:

a) Voting Members (Fleets) represented by delegates as hereinafter described,
and composed of Hobie Class Association Fleets which by their membership
in the Division accept the responsibility to carry out in their respective
areas the purposes for which the Division was organized;
-
b) Non-Voting Members composed of Individual Members who are members in
good standing of Fleets which comprise the Division. Fleets shall
determine their own membership requirements under the direction of the
World Hobie Class Association and the Division. Persons not belonging
to a Division fleet but interested in Hobie Cat activities may also become
individual members.
-
No person or Fleet resident in the geographic area of the Division who
is interested in the racing of Hobie Cats or any activity related thereto
shall be denied membership in the Division for any reason other than for
misconduct or nonpayment of dues.
-
All members shall have the privilege of attending or being represented
at all annual and special meetings of the Division. All fleet Chairmen
shall receive all publications, as the Board of Directors shall from time
to time prescribe. All Individual Members shall be eligible to hold
office and serve on Committees. Membership in the Division shall
be a prerequisite for doing so.

ARTICLE FOUR - MEETINGS

a) The Annual meeting of the Division shall be held in October, November,
or December of each year at such time and place as the Board of Directors
may determine. Notice shall be sent to all Voting Members at least twenty-one
days prior to the meeting.
-
b) The delegates representing one-quarter of all voting members shall constitute
a quorum and shall be necessary to conduct the business of the Division.
A meeting at which there is no quorum may be adjourned for a period of
not more than three weeks and the secretary shall send notice to all members
not present at the original meeting stating the date of the rescheduled
meeting.
-
c) The Division Chairman may call special Meetings of the Division when
deemed in the best interest of the Division. A notice of a Special
Meeting shall state the reason for calling the meeting and the nature of
the business to be transacted.
-
d) At the written request of a majority of the Board of Directors or at
the written request of not less than 50% of the Voting Members, the Division
Chairman shall call a Special Meeting to be held within six weeks of the
receipt of such request, and notice of the meeting shall be mailed to all
Voting Members twenty-one days before the date set for the Special Meeting.
-
e) No business other than that specified in the notice of a Special Meeting
may be dealt with at such meeting without 75% majority consent of those
attending the meeting.
ARTICLE FIVE - VOTING
-
a) Delegates in person at all meetings of the Division shall represent
Hobie Class Association Fleets. They shall be entitled to one vote per
Fleet. A Delegate’s authority to represent and vote in behalf of
the fleet, if challenged, must be in writing and attested to by the Secretary
or some other appropriate officer of the Fleet represented.

b) Delegates shall be chosen from persons who are active members in the
Fleet, which they represent.

c) A Fleet, which is delinquent in its dues or other financial obligations
to the Division, shall not be permitted to vote at any meeting of the Division.
ARTICLE SIX - ORDER OF BUSINESS

The above order of business may be changed from time to time at the discretion
of the Division Chairman.
ARTICLE SEVEN - OFFICERS
The Division shall have the following officers:

If there are more than one Vice Chairmen (or Secretary/Treasurers), one
will be designated as Senior vice Chairman (or Senior Secretary/Treasurer).

All Division officers and Fleet commodores will be NAHCA members.

ARTICLE EIGHT - DUTIES OF THE OFFICERS
-
a) Chairman: The Chairman shall preside at all meetings of the Division
and perform such other duties as may be delegated to him/her from time
to time by the Board of Directors. Specifically the duties shall
include:
-
1. Calling the annual Division Meeting,
-
2. Being the focal point for all Divisional Appeals of protest committee
rulings
-
3. Keeping track of Points Regatta results.
-
b) Vice Chairman: The Senior vice Chairman, if present, shall preside at
all meetings in the absence of the Chairman. In the event the Chairman
is unable to perform the designated duties, the Board of Directors may
designate one of the Vice-Chairmen to be Interim Chairman. Specific
duties of the Vice-Chairman include:

1. Handling logistics for Points Regattas
-
2. Advising regatta chairpersons on the conduct of regattas
-
c) Secretary-Treasurer: The Secretary-Treasurer shall keep a record
of the proceedings of all meetings of the Division and of the Board of
Directors and shall keep an accurate record of all fleets of the Division
and the officers and delegates representing the fleet. The Secretary/Treasurer
shall conduct the correspondence of the Division, send out all notices
and perform such other duties as usually pertain to the position of secretary.
Specific duties of the Secretary-Treasurer include:

1. Collecting and receiving all moneys,
-
2. Keeping a correct account thereof and depositing said moneys in such
bank or banks as may be designated by the Board of Directors,
-
3. Submitting a written report of the financial condition of the Division,
and
-
4. Submitting quarterly reports to Hobie Class Association. The Secretary-Treasurer
shall be bonded at the expense of the Division and in such amount as the
Board of Directors may determine.
-
e) The Officers of the Division, by virtue of their office, shall be members
of the Board of Directors and of the Executive Committee.
-
f) No officer or member of the Board of Directors of the Division may receive
a salary or compensation from the Division, but nothing herein shall be
construed to prevent an officer or member of the Board of Directors from
receiving compensation from the Division for duties performed in behalf
of the Division other than in the capacity of an officer or member of the
Board of Directors.
ARTICLE NINE - BOARD OF DIRECTORS

a) There shall be a Board of Directors consisting of the officers of the
Division. Members of the Board shall be selected without regard to
race, color, religion, national origin, or sex.
-
b) The Board of Directors shall have general control and management of
affairs and funds of the Division. It shall have full power and it
shall be its duty to carry out the purposes of the Division according to
law and as provided in these by-laws.
-
c) The Chairman of the Division shall preside at all meetings. In
the absence of the Chairman, the Vice-Chairman shall preside.
-
d) Two-thirds of the entire Board shall constitute a quorum and a vote
of a majority of the Board of Directors present at any meeting at which
a quorum is present shall be necessary for the transaction of business.
-
e) Without in any way limiting the powers of the Board of Directors, it
shall:
-
1. Appoint committees and chairmen thereof as it may deem appropriate to
further the purposes of the Division;
-
2. Determine the recipients of Division awards;
-
3. Fill vacancies in the officers and Board of Directors until the next
annual meeting; and
-
4. Hire all employees of the Division and fix their compensation.
-
f) Correspondence and phone may carry on the business of the Board of Directors.
The Board shall meet at the call of the Chairman. Members unable
to attend a meeting may vote by mail on questions, which have been submitted
to them for their vote. Members voting by mail shall be deemed to
be present for purposes of determining the presence of a quorum with respect
to the particular matter, which was voted on by mail.
The Board of Directors may expel or suspend any member of the Division
by a two-thirds vote of the entire Board for any violation of the by-laws
or for any conduct which in the opinion of the Board is improper and prejudicial
to the welfare, reputation, or best interests of the Division. No
member shall be expelled or suspended for a period exceeding three months
without having been given two weeks written notice of the charges and of
the time when said member can submit to the Board a written response to
such charges. Any member expelled or suspended will be prohibited
from competition, and if the member is determined to compete, the member
will not be scored nor be eligible for any awards.

ARTICLE TEN - COMMITTEES
(Other Than the Appeals Committee)
-
a) All Committees and their chairmen as herein provided should be appointed
and the Board of Directors shall delineate their duties.
-
b) All Committees shall be subject to the direction and control of the
Board of Directors, but each Committee shall be authorized to prescribe
rules and procedures for the direction of the activities assigned to it.
ARTICLE ELEVEN - ELECTION AND
TERMS OF OFFICE
-
a) The Chairman, Vice Chairmen, and Secretary-Treasurers, shall be elected
at the Annual Meeting for a term of one year and may be successively elected.
-
b) Delegates from the NAHCA Fleets shall be appointed by their respective
Fleets annually.
ARTICLE TWELVE - APPEALS COMMITTEE AND
APPEALS
-
a) The Division Appeals Committee shall consist of five members, two of
whom shall be appointed annually to serve terms of three years. In
the absence of the standing Division Appeals Committee, the Division Chairman
may appoint an interim appeals committee for the purpose of handling Division
appeals.
-
b) It shall be the duty of the Appeals Committee to hear and decide in
conformity with the Racing Rules, all appeals herein provided for.
A member of the Appeals Committee, who is the skipper, crew or owner in
whole or in part of the yacht, which is a party to an appeal, shall not
act as a member of the Appeals Committee in connection with such appeal.

c) Appeals Committee members and the Chairman of the Division appoints
their chairmen.
-
d) The Appeals Committee shall accept appeals from a competitor or representative
concerning the decision of the Race Committee or Protest Committee of the
race in question.
-
e) The decision of the Division Appeals Committee must be unanimous or
the Appeal must be sent to the NAHCA for decision.
-
f) If any party to the Appeal is dissatisfied with the decision of the
Appeals Committee, that party may appeal to the NAHCA and/or to the Appeals
Committee of the United States Sailing Association. The appealing
party is responsible for the payment of fees, if any associated with the
appeal.
-
g) The Race Committee or Protest Committee must file appeals by members
of the Division in writing within two weeks of the decision, and the procedures
for making appeals shall comply with Rules 77 and 78 of the U. S. Sailing
Racing Rules.
ARTICLE THIRTEEN - DUES
The schedule of annual dues and general fees including the regatta fee
schedule shall be established at the Annual Meeting by a majority vote.
Schedule of Dues
-
a) There are no dues to be a member of the Division.
-
b) Any NAHCA Fleet which hosts a Division sanctioned Points Regatta shall
pay a fee set at the annual meeting for each boat registered in said Regatta.
The fee shall be mailed to the Secretary-Treasurer no more than thirty
days after the regatta
-
c) A maximum registration fee for points regattas may be established at
the annual meeting. The registration fee shall cover the privilege
of racing and any meals, services, or items, which the sponsoring fleet
may designate.
ARTICLE FOURTEEN - POINTS REGATTA
RACE MANAGEMENT
-
a) US Sailing Rules shall be adhered to, except where modified by the NAHCA
Rules.
-
b) NAHCA Standard Sailing Instructions shall be used in the form supplied
by NAHCA to Division 12. Minor changes may be made in the starting
sequence and the type of marks and/or shapes used at the ends of the start
and finish lines. A copy of the sailing instructions to be used at
all Points Regattas is included in these by-laws in Article Seventeen -
Appendix 1.

c) All Points Regattas must use the flag and sound signals as shown in
Article Seventeen Appendixes 2. It is strongly recommended that races other
than Points Regattas also use the standard signals.
-
d) Points Regattas will be awarded to NAHCA Fleets at the Annual Division
Meeting. If voting is needed on the approval of individual Points
Regatta proposals, a secret ballot voting system will be used. The
Fleets with the most votes will be awarded Points Regattas. If a
tie exists for the last regatta, a secret ballot vote of only those involved
in the tie will be taken.

e) If during the process of organizing a Points Regatta, a Fleet cannot
carry out the Points Regatta for any reason, the Division Chairman may
award a Points Regatta to the Fleet receiving the next highest vote until
all perspective Fleets have been exhausted.
-
f) A one page, copy ready Regatta Information Flyer shall be mailed to
the Division Chairman by February 1st of the calendar year in which the
regatta will be held. If not received by this date, the annual Division
Regatta Booklet may be published without certain entries.
-
g) Fleets, at their choosing, may limit the size of their regattas through
registration or pre registration.

ARTICLE FIFTEEN - DIVISION POINTS
-
a) The Divisional and Regional Regattas will be scored 1.5 times the number
of points normally earned.
-
b) The calendar year will delineate the season for earning points.
-
c) Hobie 21’s only may declare a “Team” comprised of two sailors at the
beginning of the racing season. The boat name (“Team”) will receive
the recorded points. Either one of the designated “Team” must be on the
boat during races.
-
d) A sailor may bring points earned from other divisions back to Division
12 without a minimum number of boats attending the non-divisional regatta,
if the following conditions are met:
-
1. A sailor may bring no more than two (2) regatta scores to division 12
from another division.
-
2. It will be the responsibility of the skipper to notify a Division 12
officer of points earned in another division. Notification must include:
skipper's name, address and phone number; name, place and date of the regatta
attended; and name, address and phone number of the person in charge of
scoring the regatta. Lack of any of this information may disallow points
earned in other divisions.
-
e) Fleets running Points Regattas are responsible for sending the results
to NAHCA for publication in the Hobie Hotline and/or the NAHCA Newsletter.
-
f) Ties in the Division Points Standings will be broken in the following
sequence;
-
1. Total points earned at Division 12 Points Regattas for the entire season.
-
2. Comparison of every Division 12 Points Regatta. Who beat whom the most?
Whether or not the skippers involved attended the regattas.
-
3. Comparison of the last Division 12 Points Regatta, next-to-last Points
Regatta, etc.
-
g) The most current International Hobie Class Association Racing Rules
apply at all Points Regattas in Division 12.
-
h) If the number of competitors in an individual racing fleet becomes a
problem for Points Regatta organizers, it will be up to the Division Board
of Directors to decide on a system of movement between fleets as well as
qualification system for a particular fleet. If the Board of Directors
requires a decision, a list of those people qualified to race in the “A”
Fleets will be sent to all Points Regatta Chairmen. It will then
be the responsibility of the Chairmen to enforce this list.
ARTICLE SIXTEEN - AMENDMENTS
Any amendment in the By-laws shall be initiated by a majority of the
entire Board of Directors, shall be circulated to all Fleets entitled to
be represented by voting Delegates at the Annual Meeting at least 30 days
prior to the Annual Meeting or special meeting called for the purpose of
ratifying such proposed amendment, and shall not be effective until ratified
by a majority vote of the voting Delegates at an Annual or Special Meeting;
provided that if such proposed amendment is not so circulated at least
30 days prior to such meeting, the ratification of such amendment shall
require the unanimous vote of all voting Delegates at such meeting.

APPENDIX 4 - DECISIONS
1988 Decisions
-
1. A and B classes in both 16s and 18s will be combined on the start line
at Division Points Regattas, unless there are more than 50 boats registered
in the combined classes.
-
2. The start finish line will be one, located with the pin end of the line
upwind. The pin may be moved in after all classes have started in
order to shorten the finish line.
-
3. At a points regatta, there must be an A Fleet Hobie skipper who will
act as advisor to the race committee and will be designated fleet captain.
-
4. Fleets holding points Regattas will send to the Division
a fee of $2 per boat registered at the event.
-
5. Fleets may charge up to $25 for 16s, 18s, and 21s
and $20 for 17s and 14s as a registration fee for the Points Regattas.
1989 Decisions
-
1. The Division will assess a $1 per boat fine to any fleet whose results
and/or boat fees are not received within 30 days of the event.
1990 Decisions
-
1. The ‘Check-In-Check Out’ buddy system is mandatory at all Division Points
Regattas.
-
2. An additional $0.50 per boat fee is assessed at all Points Regattas
to be set aside in Division 12 funds to be paid to the NAHCA should the
need arise.
-
3. Skippers in B Fleets are required to move up to A Fleet after three
wins. Skippers may move back a class if fewer than seven points are
earned in one season.
-
4. Skippers in 16C are required to move up to B Fleet after one win (first
place) when there are five or more boats in the regatta class.
1991 Decisions
-
1. Comptips are mandatory equipment on all Hobie Cats at all Division Points
Regattas.
-
2. Fleet Race Committee’s retain the responsibility to group low
participation boats at Points Regattas/
1992 DIVISION DECISIONS
-
1. Infractions raised in protest at points regattas concerning all Coast
Guard approved safety equipment to be carried on boats will be decided
by the host fleet race committee. Division 12 abides by all Coast
Guard Rules.
-
2. Any proposal for Division 12 to host a National Event in 1995 must be
completed and submitted to Division 12 officers prior to the close of the
Division 12 Points Regatta Schedule (October 10, 1994) in order for Division
12 to select, submit and press the North American Hobie Class Association
(NAHCA) to guarantee a Northeast location in this bid. Regular Division
12 points regattas that would conflict or bracket such an event will be
canceled or rescheduled.
-
3. Division Championships are hosted by Fleet 496, Hampton Beach.
-
4. There is no financial “cap” fleets may charge for Points Regatta
entrances fees. All regatta related fees must be listed on all regatta
fliers, such as park entrance, camping, and parking fees, etc. Compulsory
Comptip and NAHCA membership regatta participation regulation statements
must appear on all event fliers.
-
5. Membership at any of the membership levels in the NAHCA is mandatory
for participation in all Division 12 Points Regattas.
-
6. Comptips are mandatory on all Hobie Catamarans participating in Division
12 Points Regattas and Division 12 Fleet events covered by Division 12
Liability Insurance.
1993 DIVISION DECISIONS
-
1. In support of US Sailing, differential entry fees will be enforced at
all Division 12 Points regattas.
-
2. 1994 Division Championships are hosted by Fleet 56, Westport, CT.
1994 DIVISION DECISIONS
-
1. Each Fleet shall be allowed at least one points regatta per season.
Only after each Fleet has secured their first date may a Fleet request
another date for a points regatta.
-
2. Skippers in B Fleet are required to move up to A Fleet after one win
(1st Place) when there are 5 or more boats in the regatta class.
Skippers in C Fleet are required to move up to B Fleet after one win (1st
Place) when there are more than 5 boats in the regatta class. This
decision supersedes Item #5, Appendix 5 “ EXISTING DIVISION GUIDELINES”.

3. The Hobie 18-SX and Magnum classes will be eliminated from championships
and an Open Class will be added.
1996 DIVISION DECISIONS
-
1. Boat Weighing. This will not be mandatory anymore. Boat
weighing will be available through John Smith. We honor reciprocity
with Division 11.

2. Membership - Should our disk be available to advertisers? We voted
NO. Only a set of labels would be available to our advertisers.
-
3. Open Novice Class - A novice open class will be sailed with the 16 C
class. Open Fleet will provide trophies for this class.
-
4. Championship Trophies - Will be perpetual trophies and will only be
given to the top finishers.
1997 DIVISION DECISIONS
-
1. Class Captains - Will be assigned to each respective boat class.
-
2. Regatta Trophies - Nacra 6.0 trophies will be produced at the discretion
of the Fleet hosting the Points Regatta.
1998 Decisions
-
1. All Division 12 Fleets will pay Division 12 insurance regardless of
whether they host a division points regatta or other events for the season.
1999 Decisions
-
1. $200 will be given to support the ‘Frostbite Series’ of racing taking
place this 1999-2000 season in Newport.
-
2. Division meetings will follow Robert’s Rules of Order (current edition).
-
3. Division championship regatta for 2000 will be at Heckscher State Park,
NY.
APPENDIX 5 - EXISTING DIVISION GUIDELINES
-
1. Each fleet will be assessed an equal portion of the Division fee for
the U S Sailing Regatta Liability and Off-The-Water Liability Insurance
cost. Each fleet shall pay such fee by December 15th in the year
proceeding the insured year. All Fleet/Division events are covered
under this USSA Regatta Liability and Off-The-Water Liability Insurance
Policy when the Division Secretary is notified, in writing, at least 10
days prior to such scheduled event. Additionally, all advertising,
fliers and materials promoting such events must carry the following disclaimer:
“This (Regatta, Event, etc. (Name)) is officially sanctioned by Division
12. (Regatta, Event, etc. (Name)) activities are staffed by Division 12
Volunteers.” (11/91)

2. The Division covers electronic score paper supplies costs. (11/91)

3. Fleet Race committees retain the responsibility to group low participation
boats at Points Regattas. (11/91)

6. Fleets holding Points Regattas will send to the Division a fee of $2
per boat registered at the event. (11/88)

7. The Division will assess a $1 per boat fine to any fleet whose results
and/or boat fees are not received within 30 days of the event. (11/89)

8. A and B Classes in both 16s and 18s will be combined on the start line
at Division Points Regattas, unless there are more than 50 boats registered
in the combined classes. (11/88)

9. The start-finish line will be one, located with the pin end of the line
upwind. The pin may be moved in after all classes have started in
order to shorten the finish line. (11/88)

10. At a Points Regatta, there must be an A Fleet Hobie skipper who will
act as advisor to the race committee and will be designated Fleet Captain.

11. At Division Points Regattas, the committee boat will be placed on the
starboard end of the line with an attempt being made to provide a slightly

COMPULSORY INFORMATION REGARDING DIVISION 12 REGATTA FLIERS
The following information has been mandated by Division 12 and must
appear on all Division 12 Regatta Fliers:

1. All Regatta fees: All registration fees, NAHCA membership at one of
the five levels, Parking, Camping, and/or any other fees relating to the
two-day event. Overnight accommodation costs may vary.

2. Comptips are mandatory at all Division 12 points regattas (See August
3, 1993 letter from Division Chair and 1992 Division 12 Meeting minutes.)

3. Insurance Disclaimer: "This regatta (event) is officially sanctioned
by Division 12. All activities are staffed by Division 12 volunteers."
